The production of images of children engaged in sexually explicit conduct, more commonly referred to as Child Pornography, is a very serious crime.  The penalties for such a violation are very serious.

Any individual who violates, or attempts or conspires to violate this statute are subject to prosecution. These include:

  • Any person who involves any minor to engage in, or who has a minor assist any other person to engage in, or who transports any minor with the intent that such minor engage in, any sexually explicit conduct for the purpose of producing any visual depiction of such conduct or for the purpose of transmitting a live visual depiction of such conduct.
  • Any parent, legal guardian, or person having custody or control of a minor who knowingly permits such minor to engage in, or to assist any other person to engage in, sexually explicit conduct for the purpose of producing any visual depiction.
  • A person who involves a minor outside of the United States, its territories or possessions, in such sexually explicit conduct described above with the intent to transport or does transport the visual depictions to the United States, its territories or possessions, by any means.
  • Any person who knowingly makes, prints, or publishes, or causes to be made, printed, or published, any notice or advertisement seeking or offering to receive, exchange, buy, produce, display, distribute, or reproduce, any visual depiction involving the use of a minor engaging in sexually explicit conductor participates in any act of sexually explicit conduct by or with any minor for the purpose of producing a visual depiction of such conduct.

The person must know or have reason to know that the process will involve commerce or travel between the states, territories, and possessions of the United States or commerce or travel between any part of the United States and any place outside the United States. Visual depictions transported or transmitted across state lines using any means or even visual depictions produced or transmitted using materials that have been mailed, shipped, or transported across state lines are subject to this statute.

Consequences of a conviction

Penalties for violating this statute range from a fine, 15 years imprisonment and registration as a sexual offender for the first time offender to death depending on the circumstances of the crime and the violator.

18 U.S. Code § 2260 – Production of sexually explicit depictions of a minor for importation into the United States

(a) Use of Minor.— A person who, outside the United States, uses a minor to produce sexually explicit images with the intent to import or transmit the visual depiction into the United States and it’s territories.

(b) Use of Visual Depiction.— A person who, outside the United States, knowingly helps in some fashion to import a sexually explicit image of a minor into the United States and it’s territories.
